END USER LICENSE AGREEMENT
This license agreement is a legal agreement between the end user (hereinafter referred to as the “User”) and the software publisher (hereinafter referred to as the “Publisher”), designating SmoothCommit Sàrl. The software and the associated documentation are hereinafter referred to as the “Product”.
By using the Product, the User unreservedly accepts all the terms and conditions set forth in this License Agreement (hereinafter referred to as the “Agreement”).
1. Purchase, Billing, and Right of Withdrawal
Payment: Orders are processed by our partner Paddle.com. Paddle is the Merchant of Record for all our transactions. By making a purchase, the User also accepts Paddle’s terms and conditions.
Right of withdrawal (EU/UK): In accordance with European legislation, the User has a period of 14 days to exercise their right of withdrawal. However, the User acknowledges that by downloading or activating the Product, they request the immediate execution of the service and thereby waive their 14-day right of withdrawal without cause.
Commercial warranty: Notwithstanding the above, the Publisher offers a 30-day “Money Back Guarantee” subject to the conditions of our Refund Policy.
2. Use and Licenses
Free Products: The Publisher provides certain products free of charge (CopyTrans Filey, CopyTrans Manager, CopyTrans HEIC for Windows, and CopyTrans Drivers Installer) exclusively for private and non-commercial use.
Evaluation Versions: Trial versions are available to allow the User to verify the compatibility of the Product with their system prior to any purchase.
Private License: The purchase of a license grants the right to use the Product for an unlimited period and includes access to updates for 2 years. A private license is limited to 5 computers within the same household and allows the management of up to 5 iOS devices.
Professional License: Any use in a commercial or corporate setting requires the purchase of a professional license. For any information or quotation requests, please contact our sales team at copytrans@copytrans.net.
3. Technical Assistance
The Publisher commits to responding to support requests via email within 24 hours for license holders. The User is invited to provide the log files necessary for diagnosis in the event of a technical malfunction. Click here to submit a support request.
4. Limitations of Liability
The Publisher disclaims any and all liability for incidental or consequential damages arising out of the use or inability to use the Product. The Product is provided “as is”, and the User assumes the risks associated with its use on their computer hardware.
5. Confidentiality
The Publisher commits to protecting the User’s personal data and not to disclose it to any third party, except in the context of processing transactions by Paddle or if required by law. The data is processed in accordance with the GDPR.
6. Copyright and Intellectual Property
The Product and the CopyTrans® trademark are the exclusive property of the Publisher. The User is prohibited from modifying, decompiling, or reverse engineering the software.
7. Competent Court and Applicable Law
This agreement is governed by French law. Any dispute relating to the execution of this agreement shall fall under the exclusive jurisdiction of the courts of Paris, France.
